Alabama Legislature
to consider restriction of Eminent Domain. ALERT The Supreme Court has
recently decided that state and local governments can take your property
for the use of developers and other private businesses unless state laws
prevent it.
Act now to stop the
abuse of eminent domain and protect your property rights!

In the special
session of the legislature which begins Tuesday, July 19, bills dealing
with eminent domain will be considered. Some will give us little
additional protection than what we have now. However, Senator Steve
French is sponsoring the Farm and Home Protection Act that will give
property owners significant new protections:

Eminent domain
cannot be used for the purpose of commercial enterprises, economic
development, revenue enhancement, perceived public good or any other
purpose than actual use by the public.

When government
takes your property for legitimate public use like a road, you will be
justly compensated not only for the property but also for your
reasonable documented relocation costs.

Just compensation
will be based on highest and best use.

Just compensation
will also have to be paid when your property is devalued by government
taking away your rights to use your property.
The other bills
dealing with eminent domain will not give you these protections. CALL YOUR
STATE SENATOR NOW and ask him to support the Farm and Home Protection Act

Alabama Attorney
General Troy King, has been challenged to crack down on abortion clinics
for failing to report cases of statutory rape. A Morgan County priest is
pushing the state's top law enforcement official to crack down on abortion
clinics that fail to report suspected cases of statutory rape.
Father James
Henderson, a pro-life activist from Somerville, says Alabama clinics have
"covered up" as many as 490 rapes in the past four years by not telling
police about girls 16 or younger who have become pregnant by older men.

Senator Jeff Sessions
shocks conservatives by suggesting that Bill Pryor should be nominated to
the U.S. Supreme Court. "The man who prosecuted Moore before the Court of
the Judiciary, former Attorney General Bill Pryor, also has been mentioned
as a possible candidate for O'Connor's seat on the Supreme Court. U.S.
Sen. Jeff Sessions, R-Ala., has encouraged the White House to consider
Pryor."

Bill Pryor remembered
as the "Liberal" Attorney General of Alabama a. As Attorney General, Bill
Pryor encouraged the spread of gambling in Alabama even though our
Constitution prohibits all forms of gambling. He aided and abetted
pedophile priests here in Alabama by allowing the law to have a big hole
so that priests and bishops could continue the secrecy of abuse. Pryor is
Catholic.

The Alabama

The writers of both
the United States and the Alabama Constitutions understood that private
property is the major cornerstone of freedom and prosperity. They clearly
recognized that there is a direct correlation between a government’s
defense of private property rights and the degree of liberty enjoyed by
its citizens.
Our Founding Fathers
and the writers of our 1901 Alabama Constitution, both having recently
escaped a tyrannical and oppressive government, knew full well the
destruction of freedom and liberty that accompanies the loss of private
property through governmental force. Both bodies clearly stated in their
constitutions that the taking of any of these rights or usages through
force of government (eminent domain) should, therefore, never be allowed
except as a last resort and then only under two conditions:
(1) a clearly
demonstrated need for “actual” public use and
(2) only after the
property owner has received just compensation for his property.
Understanding the
nature of man, they further stated that eminent domain powers shall never
be used to take property rights from one individual and give them to
another individual or business, lest the powerful dominate, oppress and
deprive the weak of their rights to “life, liberty and the pursuit of
happiness”
It is absolutely
essential that our citizens understand that ownership entails not just the
title to property, but by definition, ?permits the owner to legally
possess, use, enjoy, control, dispose of, protect and defend his
property.? They must also understand that any condemnation or confiscation
by eminent domain that results in a reduction in the usage, value or
control of private property below those rights and privileges originally
held by the owner, also constitutes a taking of private property. Any time
a taking of property rights has occurred, the property owner deserves just
compensation for these losses.
In a just and free
society, the cost of obtaining property necessary for public use should be
broadly and uniformly born by the society in general, and not unjustly
born by the individual property owner whose property has been taken.
Taking property
is taking liberty.

Governor Riley
supporting bad bill on protection of Property Rights
The Governor is
trying to push through what he calls protection of Property Rights.
According to Ken Freeman at the Alliance for Citizens Rights, this is not
the bill that is going to protect us. In an effort to avoid any
discussion, the bill is being fast-tracked into committee, and the only
chance we have to say anything about it is TOMORROW, WEDNESDAY at 9AM in
the County and Municipal Government Committee room at the Statehouse,
chaired by Bill Dukes. We know this is late notice - it was done
purposely. Anyone who can make this meeting tomorrow is needed. This may
be our only opportunity to have a say in the matter. If you can't make the
meeting please contact the Governor and your elected officials and let
them know that this is not why we sent them to Montgomery and that this
must stop!
With a re-election
attempt coming up next year, the Governor is once again letting us know
exactly who we elected in 2002. He tried to screw us with Amendment One.
He tried to screw us again last year with Amendment Two. And now he's at
it again. At one time I gave him the benefit of the doubt - I stopped that
when he looked me in the eye and lied about Amendment Two. Your help is
needed now in order to protect Private Property Rights!
